Earlier this week, the 9th Circuit Court of Appeals declined to re-hear the case of a transgender inmate in Idaho. 

This week the 9th Circuit Court of Appeals affirmed its decision in the case of Idaho inmate Adree Edmo, the transgender woman who sued the state to be provided sex reassignment surgery.

The 9th Circuit Court of Appeals has rejected Idaho’s request to rehear a case that would force it to be the first state to pay for sex reassignment surgery through a court order.

Last Friday, the 9th Circuit Court of Appeals announced their decision in the case of Adree Edmo, a transgender inmate who sued the state of Idaho for sex reassignment surgery. Edmo won. Now, Idaho Gov. Brad Little (R) plans to appeal to the Supreme Court.

Adree Edmo is a 31-year-old transgender woman serving time in an IDOC men's facility for a 2012 sexual abuse of a child under 16. She has appealed to the state to provide gender confirmation surgery while she is incarcerated. The state challenged the request and in December, a U.S. District Court ruled IDOC must provide the surgery.  A federal appeals panel has granted the state of Idaho’s request to postpone sex reassignment surgery for a transgender inmate. The inmate’s case now awaits a decision from the 9th Circuit Court of Appeals.
