The man accused of fatally stabbing a young girl and injuring eight others at a Boise birthday party earlier this summer won’t face trial until 2020.
According to KBOI-TV, lawyers for 30-year-old Timmy Earl Kinner asked for his trial to be delayed after prosecutors said they’d seek the death penalty last month.
The state did not object.
Kinner had been expected to face trial next January. The court entered a not guilty plea for him in August.
Authorities say Kinner slashed his way through a young girl’s birthday party last June, killing three-year-old Ruya Kadir and injuring several other children and adults.
He had been staying at the apartment complex on Wylie Lane, which is home to many resettled refugees.
Kinner has evaded at least one attempt by a psychologist to assess his mental competency, according to the Statesman. In another meeting, the psychologist didn’t draw any conclusions about his competency.
Kinner’s new trial is now set for January 2020.
